Terms of Service www.studia-wroclaw.pl<\/h1>\n

 <\/p>\n

I. DEFINITIONS<\/strong><\/h2>\n

Definitions used in these Terms and Conditions shall mean respectively, unless the context of their use clearly indicates otherwise:<\/p>\n

a)\u00a0Consumer<\/strong>- natural person making a legal transaction with the Service Provider which is not directly related to his\/her economic or professional activity. In the case of Consumers who are under 18 years of age or otherwise lack full legal capacity, by accepting the Terms and Conditions, they declare that they have the consent of their legal guardian to use the Services and that they will submit their legal guardian's written consent to use the Services, if requested by the Service Provider;
\nb)\u00a0Account<\/strong>- the part of the Website available to the User, after correct registration and\/or logging in (providing the Login and the password to the Account), which allows the use of the Website and the purchase of Services and products offered by the Website, as well as the modification of personal data and other elements related to the use of the Website or the Services provided;
\nc)\u00a0Login<\/strong>\u00a0- the individual and unique name of the User assigned during User registration on the Website;
\nd)\u00a0Visitors<\/strong>\u00a0- an entity that visits the Website free of charge, using the Website's services in a limited manner, specific to non-registered persons (who are not Users);
\ne)\u00a0ODR platform<\/strong>\u00a0- Access point for Consumers seeking out-of-court dispute resolution established by Regulation (EU) No 524\/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006\/2004 and Directive 2009\/22\/EC (Regulation on ODR in consumer disputes) of 2013-05-21 (Official Journal of the EU.L 2013 No. 165, p. 1);
\nf)\u00a0Cookies<\/strong>\u00a0- small textual information sent by a web server and stored on the website user's site (usually on the hard drive). The default parameters of Cookies allow the information contained in them to be read only by the party that created them;
\ng)\u00a0Platform or service<\/strong>\u00a0- the website located at www.studia-wroclaw.pl and its subpages and subdomains;
\nh)\u00a0Regulations<\/strong>\u00a0- these rules;
\ni)\u00a0Advertiser<\/strong>\u00a0- a natural person, a legal person and an organisational unit without legal personality, who commissions the Service Provider to advertise their own product or service on the Site under separate agreements;
\nj)\u00a0RODO<\/strong>\u00a0- Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 - on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC (Official Journal of the EU L No. 119 p. 1);
\nk)\u00a0Undergraduate studies<\/strong>\u00a0i\u00a0Engineering studies<\/strong>\u00a0- educational services provided by the Service Provider on the basis of a programme of study offered by the Service Provider, including through the Service, in the form of undergraduate studies and engineering studies (bachelor's degree);
\nl)\u00a0Graduate studies<\/strong>\u00a0- the educational services provided by the Service Provider on the basis of the programme of study offered by the Service Provider, including through the Service, in the form of a master's degree (second cycle studies);
\nm)\u00a0Single Master's degree programme<\/strong>\u00a0- educational services provided by the Service Provider on the basis of a programme of study offered by the Service Provider, including through the Service, in the form of a unified master's degree programme;
\nn)\u00a0Postgraduate studies<\/strong>\u00a0- educational services provided by the Service Provider on the basis of a programme of study offered by the Service Provider, including through the Service, in the form of postgraduate studies;
\no)\u00a0Contract<\/strong>\u00a0- agreement concluded at a distance by electronic means (without the physical presence of the parties) via the Website between the Service Provider and the User, the object of which is the provision by the Service Provider of Services also offered on the Website; the provisions of the Terms and Conditions constitute the content of the Agreement;
\np)\u00a0Service<\/strong>\u00a0- an opportunity to use the Website, provided by the Service Provider to Users and Visitors containing a digital service. In particular, the Services are Undergraduate Studies, Engineering Studies, Master's Studies, Uniform Master's Studies or Postgraduate Studies, courses, trainings, webinars conducted online or made available on the Website, videos made available on the Website; in case of doubt, the Service Provider clarifies that the Service provided by the Service Provider by electronic means within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended) does not fully exhaust the characteristics of the comprehensive Service provided by the Service Provider;
\nq)\u00a0Service provider<\/strong>\u00a0- Wy\u017csza Szko\u0142a Kszta\u0142cenia Zawodowego (Higher School of Vocational Education, also referred to as \"WSKZ\" in the Rules and Regulations), registered office address: Plac Powsta\u0144c\u00f3w \u015al\u0105skich 1, 53-329 Wroc\u0142aw, NIP: 7952214640, REGON: 651432712, entered in the register of non-public higher education institutions kept by the minister responsible for higher education and science under number 208, founded on 20 June 2001;
\nr)\u00a0User<\/strong>\u00a0- an entity that has duly registered on the Website and has an active Account.<\/p>\n

II. GENERAL PROVISIONS<\/strong><\/h2>\n

(1) These Regulations, in accordance with the content of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2002, No. 144, item 1204, as amended), specify in particular:<\/p>\n

a) the rules of operation and use of the Website located at: www.studia-wroclaw.pl and its subpages and subdomains related to the provision of electronic services on the Website,
\nb) regulates the rights and obligations of the Service Provider, its Users and Visitors.<\/p>\n

(2) You must read the following Terms and Conditions carefully before using the Services. Acceptance of the Terms and Conditions and confirmation of reading the Privacy Policy and Cookie Policy is required to use the Website. Each User, Visitor who proceeds to use the Website confirms that he\/she has read the Terms and Conditions, acknowledges and accepts these Terms and Conditions and confirms that he\/she has read the Privacy Policy<\/a>and\u00a0Cookie policy<\/a>, kt\u00f3rych tre\u015b\u0107 dost\u0119pna jest r\u00f3wnie\u017c w Serwisie pod adresami odpowiednio: www.studia-wroclaw.pl\/regulamin, www.studia-wroclaw.pl\/polityka-ochrony-prywatnosci oraz www.studia-wroclaw.pl\/polityka-plikow-cookies.\u00a0U\u017cytkownik zobowi\u0105zuje si\u0119 do przestrzegania obowi\u0105zuj\u0105cych w Uczelni wewn\u0119trznych akt\u00f3w prawnych, w tym regulamin\u00f3w i zarz\u0105dze\u0144. \n(3) The Service Provider shall, prior to registration on the Website, make these Terms and Conditions available to the Users, Visitors free of charge on an ICT system, which may be freely reproduced.
\n(4) The terms and conditions of these Terms and Conditions shall apply to the extent not expressly regulated otherwise in the contract concluded between the Service Provider and the User.
\n(5) The Service Provider may indicate the partners with the help of which it provides the Services, e.g. online payment operators, used by the User. The terms and conditions of these Terms and Conditions shall apply to the extent not expressly regulated otherwise in the contracts concluded between the User and the Service Provider's partners.
\n6. Wszelka korespondencja pisemna lub elektroniczna powinna by\u0107 kierowana na nast\u0119puj\u0105ce dane kontaktowe Us\u0142ugodawcy: (i) tel. +48 71 711 99 92 (koszt po\u0142\u0105czenia: op\u0142ata jak za zwyk\u0142e po\u0142\u0105czenie telefoniczne, zgodnie z pakietem taryfowym dostawcy us\u0142ug, z kt\u00f3rego korzysta U\u017cytkownik; (ii) mailowo, pod adresem e-mail: kontakt@studia-wroclaw.pl; (iii) listownie, na adres do korespondencji: Plac Powsta\u0144c\u00f3w \u015al\u0105skich 1, 53-329 Wroc\u0142aw. W celu zapewnienia optymalnej ci\u0105g\u0142o\u015bci obs\u0142ugi, Us\u0142ugodawca zastrzega mo\u017cliwo\u015b\u0107 realizacji kontaktu z innego numeru infolinii ni\u017c wskazanego w zdaniu poprzednim. Taka praktyka, ma na celu usprawnienie procesu komunikacji i zapewnienie kompleksowego wsparcia.
\n(7) The Service Provider is not responsible for the effects associated with the acquisition of additional skills through the Service.
\n(8) The place of performance of the Contract and provision of Services shall be deemed to be the Service Provider's registered office. The competent court for disputes arising from services provided by the Service Provider to Consumers shall be the court with jurisdiction over the Consumer's place of residence or the Service Provider's registered office.
\n(9) A working day shall be understood to refer to any day other than Saturdays and Sundays and other public holidays within the meaning of the Act of 18 January 1951 on public holidays (i.e. Journal of Laws 2020, item 1920).<\/p>\n

III. USE OF THE SERVICE<\/strong><\/h2>\n

1. Korzystanie z Serwisu przez Odwiedzaj\u0105cych, U\u017cytkownik\u00f3w jest dobrowolne. Przed dokonaniem rejestracji i uzyskaniem statusu U\u017cytkownika Odwiedzaj\u0105cy b\u0119dzie mia\u0142 dost\u0119p do informacji o oferowanych przez Platform\u0119 produktach, Us\u0142ugach i warunkach ich \u015bwiadczenia dost\u0119pnych w Serwisie. W razie w\u0105tpliwo\u015bci lub pyta\u0144 Odwiedzaj\u0105cy\/U\u017cytkownik mo\u017ce uzyska\u0107 szczeg\u00f3\u0142owe informacje pod adresem mailowym kontakt@studia-wroclaw.pl<\/a>.
\n2.\u00a0Odpowiedzi na najcz\u0119\u015bciej zadawane pytania mog\u0105 zosta\u0107 umieszczone w dziale \u201eCz\u0119ste pytania\u201d.
\n3.\u00a0Dokonuj\u0105c rejestracji w Serwisie U\u017cytkownik zobowi\u0105zuje si\u0119 do podania swoich prawdziwych danych osobowych, a w przypadku zmiany, r\u00f3wnie\u017c ich aktualizacji oraz o\u015bwiadcza, \u017ce zapozna\u0142 si\u0119 z\u00a0Privacy Policy<\/a>and\u00a0Cookie policy<\/a>. The Service Provider is not responsible for the provision of false personal data by the User.
\n4.\u00a0Do rozpocz\u0119cia Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych wymagane jest posiadanie wykszta\u0142cenia zgodnego z obowi\u0105zuj\u0105cymi przepisami prawa. Dokonuj\u0105c rejestracji w Serwisie na Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie lub Studia podyplomowe U\u017cytkownik o\u015bwiadcza, \u017ce posiada wymagane wykszta\u0142cenie do podj\u0119cia ww. studi\u00f3w i zobligowany jest do dostarczenia za po\u015brednictwem Platformy dokument\u00f3w wymaganych do podj\u0119cia Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych. W przypadku Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych U\u017cytkownik zobowi\u0105zany jest r\u00f3wnie\u017c przedstawi\u0107 ww. dokumenty w wersji oryginalnej do wgl\u0105du Us\u0142ugodawcy na zasadach okre\u015blonych w Regulaminie Studi\u00f3w licencjackich i Studi\u00f3w in\u017cynierskich, Regulaminie Studi\u00f3w magisterskich, Regulaminie Jednolitych studi\u00f3w magisterskich lub Regulaminie Studi\u00f3w podyplomowych. Do momentu pozytywnej weryfikacji dokument\u00f3w, o kt\u00f3rych mowa w niniejszym punkcie U\u017cytkownik nie posiada statusu studenta lub s\u0142uchacza. W przypadku negatywnej weryfikacji przedstawionych dokument\u00f3w, o kt\u00f3rych mowa niniejszym punkcie, Umowa ulegnie rozwi\u0105zaniu. Us\u0142ugodawca zastrzega sobie prawo do podj\u0119cia w ka\u017cdym czasie czynno\u015bci maj\u0105cych na celu ustalenie wiarygodno\u015bci przedstawionych dokument\u00f3w, w przypadku powzi\u0119cia przez Us\u0142ugodawc\u0119 w\u0105tpliwo\u015bci co do ich wiarygodno\u015bci.
\n5.\u00a0W przypadku, gdy dany kierunek Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych wymaga posiadania pe\u0142nej zdolno\u015bci do czynno\u015bci prawnych, prawa do korzystania z pe\u0142ni praw publicznych i\/lub z\u0142o\u017cenia o\u015bwiadczenia, \u017ce stan zdrowia pozwala na aktywne uczestniczenie w zaj\u0119ciach przewidzianych planem studi\u00f3w i programem kszta\u0142cenia, w tym realizowanie praktyk zawodowych (r\u00f3wnie\u017c w miejscach nara\u017conych na dzia\u0142anie czynnik\u00f3w szkodliwych, uci\u0105\u017cliwych lub niebezpiecznych dla zdrowia) akceptuj\u0105c Regulamin potwierdza, \u017ce spe\u0142nia powy\u017csze wymagania.
\n6.\u00a0W momencie rejestracji U\u017cytkownika na Platformie nast\u0119puje utworzenie w\u0142asnego, niepowtarzalnego Loginu oraz has\u0142a. U\u017cytkownik zobowi\u0105zany jest zachowa\u0107 nale\u017cyt\u0105 staranno\u015b\u0107 w celu zabezpieczenia tych danych przed ich nienale\u017cytym wykorzystaniem przez osoby trzecie, a w szczeg\u00f3lno\u015bci nie udost\u0119pnia\u0107 ich osobom trzecim. U\u017cytkownik ponosi wy\u0142\u0105czn\u0105 odpowiedzialno\u015b\u0107 za szkody wyrz\u0105dzone na skutek ujawnienia powy\u017cej wskazanych danych.
\n7.\u00a0Poprzez zrealizowanie procedury rejestracji U\u017cytkownika w Serwisie, kt\u00f3rej skutkiem jest za\u0142o\u017cenie Konta U\u017cytkownik zapewnia i o\u015bwiadcza, \u017ce zapozna\u0142 si\u0119 z tre\u015bci\u0105 Regulaminu, zaakceptowa\u0142 tre\u015b\u0107 ca\u0142ego Regulaminu oraz zapozna\u0142 si\u0119 z tre\u015bci\u0105\u00a0Privacy Policy<\/a>\u00a0and\u00a0Cookie policy<\/a>\u00a0made available on the Platform.
\n8.\u00a0Us\u0142ugodawca mo\u017ce zawiesi\u0107 czasowo Konto U\u017cytkownika, w przypadku dzia\u0142ania przez U\u017cytkownika na szkod\u0119 Serwisu lub innych U\u017cytkownik\u00f3w, naruszenia przez nich prawa obowi\u0105zuj\u0105cego na terytorium Rzeczypospolitej Polskiej lub ra\u017c\u0105cego naruszenia postanowie\u0144 niniejszego Regulaminu, o ile b\u0119dzie to mo\u017cliwe i celowe po uprzednim wezwaniu U\u017cytkownika do zaniechania narusze\u0144 niezw\u0142ocznie, nie p\u00f3\u017aniej ni\u017c w terminie okre\u015blonym w wezwaniu.
\n9.\u00a0Us\u0142ugodawca mo\u017ce dokona\u0107 likwidacji Konta U\u017cytkownika, je\u015bli:<\/p>\n

a)\u00a0przyczyny zawieszenia czasowego, o kt\u00f3rych mowa w pkt 8 wyst\u0119puj\u0105 \u0142\u0105cznie przez 30 dni, po uprzednim wezwaniu U\u017cytkownika lub
\nb)\u00a0w sytuacji, gdy U\u017cytkownik skierowa\u0142 do Us\u0142ugodawcy wyra\u017ane \u017c\u0105danie likwidacji Konta.<\/p>\n

(10) The Service Provider may also suspend or liquidate the Account if such a request is made by authorised authorities, in particular legal protection authorities (Police, Public Prosecutor's Office, President of the Office for Personal Data Protection and others) or courts.
\n11.\u00a0Likwidacja Konta, w sytuacjach o kt\u00f3rych mowa w pkt 9 i 10 powy\u017cej nie powoduje usuni\u0119cia danych osobowych U\u017cytkownika w sytuacji, gdy Us\u0142ugodawca przetwarza dane osobowe zgodnie z przepisami w tym, w szczeg\u00f3lno\u015bci je\u015bli jest uprawniony do dochodzenia roszcze\u0144 zwi\u0105zanych z zawart\u0105 Umow\u0105, niemniej jednak U\u017cytkownik traci mo\u017cliwo\u015b\u0107 korzystania z dotychczasowego zakresu Us\u0142ug w Serwisie przypisanych do dotychczasowego Konta.
\n12.\u00a0O czasowym zawieszeniu Konta U\u017cytkownika lub jego likwidacji Us\u0142ugodawca powiadomi U\u017cytkownika za pomoc\u0105 informacji wys\u0142anej poczt\u0105 elektroniczn\u0105 na wskazany podczas rejestracji adres poczty elektronicznej lub na adres korespondencyjny wskazany w Koncie.
\n13.\u00a0W przypadku dopuszczenia mo\u017cliwo\u015bci zamieszczania komentarzy w Serwisie, opinie na temat Us\u0142ug mog\u0105 by\u0107 zamieszczane jedynie przez U\u017cytkownik\u00f3w, kt\u00f3rzy zawarli Umow\u0119. Opinie zamieszczane mog\u0105 by\u0107 tylko po zalogowaniu si\u0119 na Konto i za po\u015brednictwem Konta przypisanego do U\u017cytkownika. Us\u0142ugodawca nie ponosi odpowiedzialno\u015bci w przypadku udost\u0119pnienia Konta przez U\u017cytkownika osobie trzeciej, kt\u00f3ra zamie\u015bci\u0142aby tak\u0105 opini\u0119.
\n14.\u00a0Komentarze oraz opinie zamieszczane przez U\u017cytkownika dotycz\u0105ce Us\u0142ugodawcy niezale\u017cnie od miejsca i sposobu nie mog\u0105 narusza\u0107 prawa obowi\u0105zuj\u0105cego na terytorium Rzeczypospolitej Polskiej lub ra\u017c\u0105co narusza\u0107 postanowie\u0144 niniejszego Regulaminu, a tak\u017ce by\u0107 wulgarne, obra\u017aliwe, godz\u0105ce w dobra osobiste Us\u0142ugodawcy lub innych os\u00f3b, wprowadzaj\u0105ce w b\u0142\u0105d, mie\u0107 charakteru reklamy, pochodzi\u0107 od innych os\u00f3b ni\u017c uprawnione do wystawienia komentarza.<\/p>\n

IV. PROTECTION OF PERSONAL DATA<\/strong><\/h2>\n

(1) The Service Provider shall ensure the protection of the Users' personal data and the data provided by them collected on the Website in a manner consistent with the RODO and the relevant legislation. Detailed information regarding the processing of Users' personal data is contained in the Privacy Policy and the Cookies Policy, available at the addresses indicated above. All questions and concerns related to personal data and its protection should be reported to the following e-mail address: kontakt@studia-wroclaw.pl.
\n(2) The personal data provided by the User will be used by the Administrator for the proper provision of the Service covered by the Agreement and for the purposes indicated in the Privacy Policy and the Regulations, in particular they may be made available to other entities cooperating with the Service Provider. The sharing will be carried out on the basis of the User's consent expressed as a willingness to use the offered service, including through the Service.
\n3 The Administrator advises the User to keep his\/her personal data up to date and warns of the risks associated with omission.
\n(4) Personal data shall be provided by the User on a voluntary basis, with the proviso that failure to provide such data or the provision of false data may render the Service impossible.<\/p>\n

V. SERVICE OBJECTIVES AND CONDITIONS, TECHNICAL REQUIREMENTS<\/strong><\/h2>\n

(1) The Services provided by the Service Provider via the Website consist in particular in making all or part of the resources of the Website available to the Users, Visitors, electronically, as well as enabling the Users to use the Services under the terms of these Terms of Use.
\n2.\u00a0Us\u0142ugodawca prowadzi Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie i Studia podyplomowe w formie i w spos\u00f3b zgodny z obowi\u0105zuj\u0105cymi przepisami prawa.
\n3.\u00a0Us\u0142ugi mog\u0105 by\u0107 \u015bwiadczone odp\u0142atnie lub nieodp\u0142atnie. Opis dost\u0119pnych Us\u0142ug znajduje si\u0119 w Serwisie.
\n4.\u00a0Us\u0142ugi odp\u0142atne s\u0105 \u015bwiadczone wy\u0142\u0105cznie na rzecz U\u017cytkownik\u00f3w po zarejestrowaniu w Serwisie Konta. Us\u0142ugami p\u0142atnymi \u015bwiadczonymi przez Us\u0142ugodawc\u0119 s\u0105:<\/p>\n

(a) Undergraduate Studies and Engineering Studies;
\n(b) Master's degree;
\n(c) Single master's degree programmes;
\nd)\u00a0Studia podyplomowe;
\n(e) courses, training;
\n(f) making video material available;
\ng) conducting online webinars and\/or making them available on the Service and\/or Account.<\/p>\n

5 Free Services may be provided to Visitors and Users. The free services provided by the Service Provider are:<\/p>\n

a) to enable the creation of an Account;
\n(b) enabling the conclusion of Contracts in accordance with the Terms and Conditions.
\nThe Service Provider may also provide other services free of charge to Visitors and Users.<\/p>\n

(6) The Agreement for the provision of services electronically in the scope of free services is concluded at the moment of creating an Account on the Website. The Agreement for the provision of services, including electronically in the scope of paid services, is concluded at the moment of receipt by the User of an e-mail confirming the conclusion of the Agreement, unless the Regulations state otherwise.
\n(7) In the case of persons who do not have full legal capacity on the date of commencement of the Paid Service, by accepting the Terms and Conditions they declare that they have the consent of their legal guardian to use the Services and that they will submit written consent of their legal guardian to use the Services upon request of the Service Provider.
\n8. Us\u0142ugi p\u0142atne s\u0105 wyra\u017anie oznaczone ze wskazaniem koszt\u00f3w, jakie U\u017cytkownik\/Podmiot ubiegaj\u0105cy si\u0119 o dofinansowanie ponosi. W przypadku Us\u0142ug p\u0142atnych Us\u0142ugodawca mo\u017ce stosowa\u0107, jednak\u017ce nie ma takiego obowi\u0105zku, wedle swojego uznania, zni\u017cki, bonifikaty, upusty, itp. 9 The method of payment shall depend on the type of Service provided and shall be indicated in each case on the Platform with the possibility of reading the method of payment before concluding the Contract.
\n(10) By submitting an offer to conclude an Agreement, the User or Visitor (in the case of free Services) confirms that he\/she has read the description, terms and conditions and the Terms and Conditions and that he\/she accepts all the provisions of these Terms and Conditions.
\n(11) In order to use the Website's functionalities and Services, it is necessary for the User to have a computer with access to the public Internet, an active e-mail account, an Internet resource browser enabling the display of websites (Internet browsers with cookies and JavaScript enabled\/saved; browser versions - not older than 12 months) and to have an active Account on the Website.
\n(12) In the event of any non-compliance of the Services with the Terms and Conditions, the User or Visitor shall cooperate with the Service Provider to a reasonable extent to determine whether the non-compliance of the Services with the Terms and Conditions is due to the characteristics of the User's or Visitor's digital environment. In the event of non-compliance of the Services with the Regulations, the Consumer shall be entitled to the legal remedies provided for by the common law.
\n(13) The costs of Internet access shall be borne by the User or Visitor (in the case of free Services), also in the case of use of the Internet by mobile phone. The aforementioned users of the Services should familiarise themselves with the transfer (Internet connection) rates applied by the telecommunications operators.
\n14 The Service Provider uses cookies to collect information related to the use of the Website by the User or Visitor (in the case of free Services). For detailed information on the use of cookies, please refer to the Cookie Policy.
\n15. use of the Website for the purpose of using paid Services is possible after Registration. The procedure for Registration and Account activation is described in Chapter VI of the Terms and Conditions.
\n(16) By accepting the Terms and Conditions, the User agrees to conclude the Agreement by means of distance communication, i.e. e-mail or electronic order form, and requests the commencement (agrees to perform) of the provision of the Services before the expiry of the deadline for withdrawal from the Agreement being aware and accepting that he\/she thereby forfeits the right to withdraw from the Agreement in the event of performance of the Services by the Service Provider. At the same time, the User declares that he\/she is aware that in such a case he\/she will be obliged to pay the amount for the services performed by the Service Provider for his\/her benefit.
\n(17) The Service Provider may operate a newsletter service, by means of which it enables Users to familiarise themselves with the news and current offer of the Website after they have expressly consented to the sending of commercial information by electronic means. The use of the newsletter service is voluntary.
\n18 The Service Provider shall not be responsible for the granting and renewal of rights regulated by applicable law.<\/p>\n

VI. REGISTRATION<\/strong><\/h2>\n

(1) In order to place an order for the provision of paid Services, including electronically via the Website, you must register on the Website and then enter your personal data via the appropriate tab. Registration is free of charge.

\n(3) During registration, Users provide their data and information necessary to set up an Account, in particular:<\/p>\n

(a) name,
\n(b) name,
\n(c) PESEL,
\nd) e-mail address (confirming that this is the e-mail belonging to him\/her, to which a set of data will be sent to enable the Services to be performed),
\n(e) telephone number.<\/p>\n

The user is obliged to fill in all fields marked as mandatory on the registration form. Failure to complete fields marked as mandatory may prevent the registration process from being successfully completed.
\n(5) The data provided in the registration form must relate to the User who will use the Service and must be truthful.
\n6 A correctly completed registration form and the Terms and Conditions accepted by the User are saved in the Service database.
\n7 The correctly filled in registration form and the Terms and Conditions accepted by the User constitute the basis for the functioning of the Account.
\n(8) Upon completion of the registration process, the User is provided with a password and login to the Service account.
\n(9) The User accepts the necessity of having a valid, active e-mail address. This address is provided directly upon Registration. The User is obliged to monitor the e-mail address provided on an ongoing basis and, if it changes, to inform the Service Provider immediately.
\n(10) The e-mail address is linked to the Account, is a necessary form of identification of the User vis-\u00e0-vis the Service Provider and will be used for all correspondence related to the provision of the Services.<\/p>\n

VII.\u00a0STUDIA LICENCJACKIE, STUDIA IN\u017bYNIERSKIE, STUDIA MAGISTERSKIE, JEDNOLITE STUDIA MAGISTERSKIE I STUDIA PODYPLOMOWE<\/strong><\/h2>\n

1. Us\u0142ugodawca prowadzi Studia licencjackie i\/lub Studia in\u017cynierskie i\/lub Studia magisterskie i\/lub Jednolite studia magisterskie i\/lub Studia podyplomowe. Po zako\u0144czeniu toku nauczania Us\u0142ugodawca wydaje U\u017cytkownikom dyplomy uko\u0144czenia Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich lub Jednolitych studi\u00f3w magisterskich lub \u015bwiadectwo uko\u0144czenia Studi\u00f3w podyplomowych.
\n2.\u00a0WSKZ jest administratorem Serwisu. WSKZ mo\u017ce umo\u017cliwi\u0107 \u015bwiadczenie Us\u0142ug r\u00f3wnie\u017c innym podmiotom nieb\u0119d\u0105cym Konsumentem prowadz\u0105cym m.in. Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie, Studia podyplomowe, kursy, szkolenia lub praktyki. WSKZ nie jest stron\u0105 takich um\u00f3w, a zawarcie umowy z podmiotem trzecim odbywa\u0107 si\u0119 b\u0119dzie na zasadach ka\u017cdorazowo zaakceptowanych przez U\u017cytkownika.
\n3.\u00a0Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie i Studia podyplomowe s\u0105 Us\u0142ug\u0105 p\u0142atn\u0105.
\n4.\u00a0Zam\u00f3wienie Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych wymaga zarejestrowania si\u0119 w Serwisie zgodnie z zasadami okre\u015blonymi w Regulaminie. Poprzez z\u0142o\u017cenie zam\u00f3wienia, U\u017cytkownik sk\u0142ada ofert\u0119 zawarcia umowy.

\n5.\u00a0Us\u0142ugodawca zastrzega sobie prawo odwo\u0142ania naboru na Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie lub Studia podyplomowe lub zaprzestania ich realizacji z zachowaniem jednak obowi\u0105zku zwrotu op\u0142aty za zakupion\u0105 Us\u0142ug\u0119, na konto wskazane przez U\u017cytkownika w wiadomo\u015bci mailowej\u00a0kontakt@studia-wroclaw.pl<\/a>subject to the provisions of the Rules of Procedure.
\n6.\u00a0U\u017cytkownik wybiera Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie lub Studia podyplomowe i dokonuje p\u0142atno\u015bci zgodnej z cen\u0105 za Us\u0142ug\u0119 okre\u015blon\u0105 w Serwisie w chwili dokonania rejestracji na studia. Cena Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich i Studi\u00f3w podyplomowych mo\u017ce by\u0107 zr\u00f3\u017cnicowana w zale\u017cno\u015bci od wybranego wariantu p\u0142atno\u015bci (p\u0142atno\u015b\u0107 jednorazowa, semestralna lub czesne). Cena wskazywana jest przy sk\u0142adaniu zam\u00f3wienia. Przy wyborze Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich i Studi\u00f3w podyplomowych w wariancie p\u0142atno\u015bci semestralnej lub p\u0142atno\u015bci za czesne p\u0142atno\u015b\u0107 powinna nast\u0105pi\u0107 we wskazanych w harmonogramie terminach p\u0142atno\u015bci. Przedmiotowy harmonogram udost\u0119pniany jest po zalogowaniu na indywidualnym Koncie U\u017cytkownika. Wyb\u00f3r wariantu p\u0142atno\u015bci semestralnej lub p\u0142atno\u015bci za czesne za Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie lub Studia podyplomowe nie oznacza podzia\u0142u Umowy na niezale\u017cne cz\u0119\u015bci. Za ka\u017cdy dzie\u0144 op\u00f3\u017anienia w ww. p\u0142atno\u015bciach Us\u0142ugodawca mo\u017ce \u017c\u0105da\u0107 od U\u017cytkownika odsetek ustawowych. W przypadku powstania nadp\u0142aty podlega ona zaliczeniu na poczet przysz\u0142ych p\u0142atno\u015bci o ile wp\u0142acaj\u0105cy tj. U\u017cytkownik nie za\u017c\u0105da jej zwrotu.
\n7.\u00a0U\u017cytkownik w ramach wybranego kierunku Studi\u00f3w licencjackich lub Studi\u00f3w in\u017cynierskich zobowi\u0105zany jest nie p\u00f3\u017aniej ni\u017c w terminie trzech miesi\u0119cy od rozpocz\u0119cia trzeciego semestru studi\u00f3w dokona\u0107 wyboru specjalno\u015bci podstawowej oferowanej przez Us\u0142ugodawc\u0119. Realizacja przedmiot\u00f3w w ramach wybranej specjalno\u015bci podstawowej rozpocznie si\u0119 z pocz\u0105tkiem czwartego semestru studi\u00f3w. W przypadku uchybienia terminowi wyboru specjalno\u015bci podstawowej przez U\u017cytkownika Us\u0142ugodawca zastrzega sobie prawo przyporz\u0105dkowania U\u017cytkownikowi specjalno\u015bci wed\u0142ug w\u0142asnego wyboru. U\u017cytkownik zostanie poinformowany o powy\u017cszym wyborze przez Us\u0142ugodawc\u0119. Po dokonaniu wyboru specjalno\u015bci podstawowej w spos\u00f3b opisany powy\u017cej U\u017cytkownikowi nie przys\u0142uguje prawo do jej zmiany.
\n8.\u00a0U\u017cytkownik w ramach wybranego kierunku Studi\u00f3w magisterskich zobowi\u0105zany jest nie p\u00f3\u017aniej ni\u017c w terminie dw\u00f3ch tygodni od rozpocz\u0119cia kszta\u0142cenia w ramach pierwszego semestru studi\u00f3w dokona\u0107 wyboru specjalno\u015bci podstawowej oferowanej przez Us\u0142ugodawc\u0119. Realizacja przedmiot\u00f3w w ramach wybranej specjalno\u015bci podstawowej rozpocznie si\u0119 z pocz\u0105tkiem drugiego semestru studi\u00f3w. W przypadku uchybienia terminowi wyboru specjalno\u015bci podstawowej przez U\u017cytkownika, Us\u0142ugodawca zastrzega sobie prawo przyporz\u0105dkowania U\u017cytkownikowi specjalno\u015bci wed\u0142ug w\u0142asnego wyboru. U\u017cytkownik zostanie poinformowany o powy\u017cszym wyborze przez Us\u0142ugodawc\u0119. Po dokonaniu wyboru specjalno\u015bci podstawowej w spos\u00f3b opisany powy\u017cej, U\u017cytkownikowi nie przys\u0142uguje prawo do jej zmiany.
\n9.\u00a0U\u017cytkownik w ramach wybranego kierunku Jednolitych studi\u00f3w magisterskich zobowi\u0105zany jest w terminie trzech miesi\u0119cy od rozpocz\u0119cia drugiego semestru studi\u00f3w dokona\u0107 wyboru specjalno\u015bci podstawowej oferowanej przez Us\u0142ugodawc\u0119. Realizacja przedmiot\u00f3w w ramach wybranej specjalno\u015bci podstawowej rozpocznie si\u0119 z pocz\u0105tkiem trzeciego semestru studi\u00f3w. W przypadku uchybienia terminowi wyboru specjalno\u015bci podstawowej przez U\u017cytkownika, Us\u0142ugodawca zastrzega sobie prawo przyporz\u0105dkowania U\u017cytkownikowi specjalno\u015bci wed\u0142ug w\u0142asnego wyboru. U\u017cytkownik zostanie poinformowany o powy\u017cszym wyborze przez Us\u0142ugodawc\u0119. Po dokonaniu wyboru specjalno\u015bci podstawowej w spos\u00f3b opisany powy\u017cej, U\u017cytkownikowi nie przys\u0142uguje prawo do jej zmiany.
\n9a. In the event that the number of Users who have signed up for a basic specialisation proves to be insufficient to launch it, the specialisation in question may not be launched. In that case - if the basic specialty is not launched - the User will select another available basic specialty. If the User does not select a basic speciality, the Service Provider reserves the right to assign a speciality of the User's choice.
\n10.\u00a0Tytu\u0142em przeprowadzenia post\u0119powania kwalifikacyjnego od kandydat\u00f3w na Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie lub Jednolite studia magisterskie mo\u017ce by\u0107 pobierana przez Us\u0142ugodawc\u0119 op\u0142ata wpisowa, na kt\u00f3r\u0105 sk\u0142ada si\u0119: op\u0142ata rekrutacyjna oraz op\u0142ata administracyjna. Wysoko\u015b\u0107 op\u0142at jest widoczna przy sk\u0142adaniu zam\u00f3wienia. Us\u0142ugodawca zastrzega sobie prawo do wprowadzania zmian w wysoko\u015bci op\u0142aty administracyjnej (zapis nie dotyczy zam\u00f3wionych Us\u0142ug w trakcie ich realizacji).
\n10a.\u00a0Tytu\u0142em przeprowadzenia post\u0119powania kwalifikacyjnego od kandydat\u00f3w na Studia podyplomowe, mo\u017ce by\u0107 pobierana przez Us\u0142ugodawc\u0119 op\u0142ata wpisowa. Wysoko\u015b\u0107 op\u0142aty wpisowej jest widoczna przy sk\u0142adaniu zam\u00f3wienia. Us\u0142ugodawca zastrzega sobie prawo do wprowadzania zmian w wysoko\u015bci op\u0142aty wpisowej (zapis nie dotyczy zam\u00f3wionych Us\u0142ug w trakcie ich realizacji).
\n11.\u00a0Na op\u0142at\u0119 wpisow\u0105, o kt\u00f3rej mowa w pkt 10 sk\u0142ada si\u0119 m.in. obs\u0142uga administracyjna zwi\u0105zana z przesy\u0142an\u0105 dokumentacj\u0105, zapewnienie sprawnej obs\u0142ugi kandydat\u00f3w na studia, w tym poprzez infolini\u0119, za\u0142o\u017cenie indywidualnego konta studenta, wdro\u017cenie i utrzymanie system\u00f3w informatycznych, analiza zapotrzebowania w zakresie odpowiedniej kadry dydaktycznej, administracyjnej, a tak\u017ce infrastruktury technicznej dostosowanej m.in. do ilo\u015bci potencjalnych student\u00f3w, analiza wniosk\u00f3w sk\u0142adanych przez kandydat\u00f3w na studia, w tym m.in. o indywidualn\u0105 organizacj\u0119 studi\u00f3w oraz rozpatrzenie przedmiotowych wniosk\u00f3w przez w\u0142adze Uczelni.
\n12.\u00a0U\u017cytkownik ma prawo do rezygnacji ze z\u0142o\u017conego zam\u00f3wienia, z kt\u00f3rego mo\u017ce skorzysta\u0107 do chwili potwierdzenia zam\u00f3wienia przez Serwis, kt\u00f3ry to moment oznacza zawarcie Umowy. Rezygnacja z zam\u00f3wienia nast\u0119puje za po\u015brednictwem Serwisu, mailowo na adres\u00a0kontakt@studia-wroclaw.pl<\/a>.
\n13.\u00a0Przy wyborze wariantu Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych z wariantem p\u0142atno\u015bci semestralnej lub p\u0142atno\u015bci za czesne szczeg\u00f3\u0142y dotycz\u0105ce ceny zawarte s\u0105 w opisach ka\u017cdego z kierunk\u00f3w Studi\u00f3w licencjackich, Studi\u00f3w in\u017cynierskich, Studi\u00f3w magisterskich, Jednolitych studi\u00f3w magisterskich lub Studi\u00f3w podyplomowych oraz w udost\u0119pnionym na Koncie U\u017cytkownika harmonogramie. W takim wypadku p\u0142atno\u015b\u0107 za Studia licencjackie, Studia in\u017cynierskie, Studia magisterskie, Jednolite studia magisterskie lub Studia podyplomowe winna nast\u0105pi\u0107 zgodnie z harmonogramem.
\n14.\u00a0Na Koncie U\u017cytkownika widnieje informacja o statusie p\u0142atno\u015bci za Us\u0142ug\u0119, aktualizowana ka\u017cdorazowo po uznaniu konta Us\u0142ugodawcy.
\n15.\u00a0Umowa zostaje zawarta z chwil\u0105 otrzymania przez U\u017cytkownika wiadomo\u015bci z potwierdzeniem zawarcia Umowy.
\n16.\u00a0Priorytetem Us\u0142ugodawcy jest prowadzenie najwy\u017cszej jako\u015bci kszta\u0142cenia. Us\u0142ugodawca zapewnia najwy\u017csz\u0105 jako\u015b\u0107 kszta\u0142cenia w szczeg\u00f3lno\u015bci stosuj\u0105c system zapewniania jako\u015bci kszta\u0142cenia.
\n17.\u00a0Skala ocen pracy dyplomowej (o ile jej napisanie przewiduje program danych studi\u00f3w) jest nast\u0119puj\u0105ca: bardzo dobra (5), dobry plus (4,5), dobra (4), dostateczna plus (3,5), dostateczna (3), niedostateczna (2).
\n18.\u00a0U\u017cytkownik zobowi\u0105zany jest do rzetelnego, samodzielnego powtarzania materia\u0142u przekazanego mu w czasie trwania kszta\u0142cenia.
\n19.\u00a0Dla kszta\u0142cenia przygotowuj\u0105cego do wykonywania zawodu nauczyciela obowi\u0105zuje nowy standard kszta\u0142cenia zgodny z rozporz\u0105dzeniem Ministra Nauki i Szkolnictwa Wy\u017cszego z dnia 25 lipca 2019 r. w sprawie standardu kszta\u0142cenia przygotowuj\u0105cego do wykonywania zawodu nauczyciela (Dz. U. z 2019 r. poz. 1450 ze zm.). W razie zmiany\/uchylenia ww. rozporz\u0105dzenia kszta\u0142cenie odbywa\u0107 si\u0119 b\u0119dzie w zgodzie z jego zmienion\u0105 tre\u015bci\u0105 lub innym aktem prawnym powszechnym reguluj\u0105cym standardy kszta\u0142cenia.
\n20.\u00a0Warunkiem uko\u0144czenia Studi\u00f3w licencjackich lub Studi\u00f3w in\u017cynierskich jest:<\/p>\n

a)\u00a0uzyskanie efekt\u00f3w uczenia si\u0119 okre\u015blonych w programie studi\u00f3w, kt\u00f3rym przypisano co najmniej 180 punkt\u00f3w ECTS \u2013 w przypadku Studi\u00f3w licencjackich, a 210 punkt\u00f3w ECTS \u2013 w przypadku Studi\u00f3w in\u017cynierskich;
\n(b) the minimum attendance required by the Regulations for Undergraduate Studies and Engineering Studies;
\n(c) to take the diploma examination, in the form provided for in the study programme;
\n(d) a satisfactory assessment of the thesis, insofar as provided for in the study programme.<\/p>\n

21 The prerequisite for the completion of the Master's Degree is:<\/p>\n

(a) the achievement of the learning outcomes specified in the programme of study, which have been allocated at least 90 ECTS credits;
\n(b) the minimum attendance required by the MA Regulations;
\n(c) taking the diploma examination;
\n(d) a positive assessment of the thesis.<\/p>\n

22. the prerequisite for completion of the Single Master's degree programme is:<\/p>\n

(a) the achievement of the learning outcomes specified in the programme of study, which have been allocated at least 300 ECTS credits - in the case of a single master's degree programme lasting 9 or 10 semesters;
\nb) the achievement of the learning outcomes specified in the programme of study, which have been allocated at least 360 ECTS credits - in the case of a single master's degree programme lasting 11 or 12 semesters;
\n(c) the minimum attendance required by the Regulations of the Unified Master's Degree Programme;
\n(d) taking the diploma examination;
\n(e) a positive assessment of the thesis.<\/p>\n

23. Warunkiem uko\u0144czenia Studi\u00f3w podyplomowych jest:<\/p>\n

(a) the achievement of the learning outcomes specified in the programme of study, to which at least 30 ECTS credits have been attributed;
\n(b) minimum attendance to be set by the authorities of the Service Provider;
\nc)\u00a0uzyskanie pozytywnego wyniku z egzaminu ko\u0144cowego i\/lub pozytywna ocena pracy dyplomowej.<\/p>\n

(24) The Service Provider shall issue a diploma of completion of a Bachelor's Degree, Engineering Degree, Master's Degree or Uniform Master's Degree to a User who has completed a Bachelor's Degree, Engineering Degree, Master's Degree or Uniform Master's Degree in a specific field and profile confirming higher education and a Bachelor's, Engineer's or Master's degree confirming higher education at that level. Within 30 days from the date of graduation, the Service Provider shall issue a diploma of completion of the Bachelor's Degree, Engineering Degree, Master's Degree or Uniform Master's Degree together with a supplement to the diploma and 2 copies thereof, including, at the written request of the graduate, a copy thereof in a foreign language.
\n25 The service provider is not responsible for the actions and omissions of courier companies and postal operators.
\n(26) Documentation of completion of Bachelor's Studies, Engineering Studies, Master's Studies or Unified Master's Studies shall be forwarded via courier companies or postal operators. The Service Provider reserves the right to oblige the User to pay a fee for the re-sending of the Bachelor's Degree, Engineering Degree, Master's Degree or Uniform Master's Degree completion documentation via courier company or postal operator in the event of an unsuccessful attempt to deliver the aforementioned documents to the address indicated by the User and to return the documents back to the Service Provider.
\n(27) In order to issue the relevant documents on the completion of Bachelor's Studies, Engineering Studies, Master's Studies or Unified Master's Studies (e.g. the relevant diploma), the Service Provider may request the information necessary for their issuance, in particular where this is provided for by applicable law.
\n(28) In the event that the documentation confirming the completion of Bachelor's Studies, Engineering Studies, Master's Studies or Uniform Master's Studies requires rectification due to the User's fault (as a result of incorrect input of personal data by the User, on the basis of which a given document is generated), the Service Provider shall prepare and send the corrected document to the address indicated by the User for an additional fee. The User will be obliged to pay a fee of PLN 50.00 to the Service Provider for this, with the proviso that this fee includes the preparation and sending of one copy of the modified document by the Service Provider. The preparation and sending of the corrected document(s) to the User is subject to prior delivery by the User to the Service Provider of the previous documentation containing incorrect data and payment of the fee referred to above.
\n(29) Each User declares that he\/she is aware of the provisions of the applicable law governing the need for relevant qualifications and the conditions enabling him\/her to undertake Bachelor's Studies, Engineering Studies, Master's Studies or Unified Master's Studies in the field of study of his\/her choice, including in particular those arising from the Act of 20 July 2018 Law on Higher Education and Science (Journal of Laws of 2018. item 1668 as amended) and (if applicable) from the Regulation of the Minister of Science and Higher Education of 25 July 2019 on the standard of education preparing for the teaching profession (Journal of Laws of 2019, item 1450 as amended), the Regulation of the Minister of Education and Science of 14 September 2023 on detailed qualifications required of teachers (Journal of Laws of 2023, item 2102), and declares that he or she has the above qualifications and meets the above conditions. Each User also declares that he\/she is aware of the fact that courses of study of a qualifying nature offer the possibility of obtaining qualifications within the meaning of the relevant legal regulations once the User meets the conditions specified therein. If the User does not meet these conditions, the studies are of a competence-based nature and enable the User to increase his or her existing knowledge, skills and competitiveness on the labour market.
\n(30) The service provider reserves the right to make changes to course programmes during the academic year in cases arising from generally applicable law.
\n31 The Service Provider reserves the right to set a maximum deadline in the study programme for the User to submit documents confirming the completion of internships for the selected courses of Bachelor's Studies, Engineering Studies, Master's Studies and Single Master's Studies.
\n(32) As part of the Service, the Service Provider may enable the organisation and delivery of, inter alia, courses, training or apprenticeships to other entities by making, inter alia, courses, training or apprenticeships available in the User Account.
\n33. Regulaminie Studi\u00f3w licencjackich i Studi\u00f3w in\u017cynierskich, Regulaminie Studi\u00f3w magisterskich, Regulaminie Jednolitych studi\u00f3w magisterskich lub Regulaminie Studi\u00f3w podyplomowych), kt\u00f3ra nast\u0105pi\u0142a po rozpocz\u0119ciu \u015bwiadczenia Us\u0142ug przez Us\u0142ugodawc\u0119, wszelkie naliczone op\u0142aty s\u0105 zgodne z zasad\u0105 proporcjonalno\u015bci i dotycz\u0105 okresu \u015bwiadczenia Us\u0142ug do dnia z\u0142o\u017cenia rezygnacji.<\/p>\n

\u00a0VIII. PAYMENT FOR SERVICES<\/strong><\/h2>\n

The price of the individual Services can be found on the Website. The amounts indicated are gross amounts.
\n(2) The Service Provider reserves the right to change the prices of individual Services and products posted on the Website, with the proviso that the change will not apply to Services and products already purchased.
\n(3) Settlement of transactions for electronically provided services shall be carried out through PayPro S.A. in accordance with its regulations made available by PayPro S.A. during the transaction on the payment platform.
\nThe operator of the payment cards is PayPro S.A. Clearing Agent, ul. Pastelowa 8, 60-198 Pozna\u0144, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Pozna\u0144 Nowe Miasto and Wilda in Pozna\u0144, VIII Economic Division of the National Court Register under KRS number 0000347935, NIP 7792369887, Regon 301345068.<\/p>\n

IX. LIABILITY OF THE PARTIES, TECHNICAL INTERRUPTIONS, PROHIBITED CONTENT<\/strong><\/h2>\n

(1) The Service Provider declares that all materials and information comprising the Service are obtained and edited with due diligence to ensure the reliability, timeliness and completeness of the Service provided.
\n1a. The Service Provider declares that it will provide the Service to the Consumer via the Account immediately after the conclusion of the Agreement, unless a different time of commencement of the Service results from generally applicable law, including in particular the date of commencement of the academic year.
\n(2) In the process of selection of materials for the implementation of the Service, the Service Provider shall use its own materials and those obtained, pursuant to the applicable legislation, from external entities. The Service Provider is entitled to all economic copyrights to all works within the Service, including but not limited to educational materials.
\n(3) Any copying, distribution and sharing of the content of the Service, including through the Account without the prior written consent of the Service Provider is prohibited.
\n(4) The name of the Service, its concept, graphic design, software, collected materials and databases are protected by law. The User shall not have the right to commercially exploit, sell, resell or in any other way transfer, copy, distribute or promote the content made available as part of the Service, including through the Account. You shall also not have the right to use the provided content in a way that requires a licence for public use (reproduction).
\n(5) You are solely responsible for the nature and content of the content you post in your Account and for your participation in activities under the Services provided. The Service Provider shall not be liable in any way for the content, subject to Article 14 of the Act on Provision of Electronic Services. It is forbidden for the User to post content that violates the provisions of generally applicable law, including, in particular, the provisions concerning the protection of copyright, personal rights, criminal law.
\nThe Service Provider is not liable for the actions and omissions of Visitors, Users, in particular for infringement of personal rights, trademarks or copyrights of third parties.
\nIf the User becomes aware of any content posted on the Site that violates these Terms of Use or generally applicable laws, he\/she should communicate it to the Service Provider by e-mail to the following address: kontakt@studia-wroclaw.pl.
\n(8) Unless otherwise expressly agreed, the User shall not be entitled to any remuneration for posting content on the Website.
\n(9) The Service Provider reserves the right to prevent access to those contents which, based on reports from third parties or the relevant authorities, are found to be unlawful or to be associated with unlawful activity.
\n10. each User, Visitor undertakes to comply with the law, including in particular:<\/p>\n

(a) data protection legislation,
\n(b) provisions on the protection of personal rights,
\nc) copyright and related rights legislation, including economic copyright and moral rights,
\n(d) industrial property rights legislation,
\n(e) criminal law, misdemeanour law or other offences regulated by applicable legislation,
\nf) the provisions of the law governing the provision of services by electronic means, in particular the sending of unsolicited commercial information or so-called spam, and undertakes not to use any techniques or devices interfering with the operation of the Site's IT infrastructure or aimed at breaking the Site's security, not to interfere with the databases available on the Site, not to undertake any other actions which are unlawful or inconsistent with the purpose of the Site, in particular those resulting in damage to the Service Provider or other entities using the Site, in particular Users, Visitors and Advertisers.<\/p>\n

(11) The use of the Website and participation in activities within the scope of the Services provided does not result in the acquisition by the User\/Visitor of any rights on intangible property to the works contained therein. Users and Visitors may use these works only to the extent permitted by the Act on Copyright and Related Rights.
\n(12) The User agrees not to create accounts, groups on websites, including social media, which may suggest in an unauthorised manner that this is an account, group of which the Service Provider is the administrator. The suggestion that the Service Provider is the administrator of the aforementioned account, group shall be understood in particular (although not exclusively) as the use of the Service Provider's logo and name (including the abbreviated name), the posting of materials the rights to which belong to the Service Provider, advertising slogans, etc.
\n(13) The Service Provider declares that the Service Provider may assert the claims foreseen by the applicable legal provisions against the infringers, including in particular compensation for damages in the form of both actual damage to property (damnum emergens) and lost profits (lucrum cessans) or compensation for damages.
\n(14) The Service Provider undertakes to use due diligence to provide the Service continuously and uninterruptedly, subject to the need to carry out the required maintenance work or for reasons of force majeure.
\n15 The Service Provider undertakes to inform Users of planned technical interruptions, which are necessary due to technical considerations, and which result, among other things, from the specific nature of the operation of the Platform via the Internet.
\n16 The Service Provider reserves the right to briefly interrupt the operation of the Website in the event of planned, ongoing operation and maintenance of the server and the Website software.<\/p>\n

X. POST\u0118POWANIE REKLAMACYJNE I ZASTRZE\u017bENIA \/ POZAS\u0104DOWE SPOSOBY ROZPATRYWANIA REKLAMACJI PRZEZ KONSUMENTA<\/strong><\/h2>\n

(1) The Service Provider shall be liable for the correct performance of the Service and vis-\u00e0-vis the Consumer for the conformity of the delivered Service with the content of the Contract. The regulation of this liability is contained in particular in the provisions of the Act of 23 April 1964. - Civil Code (Journal of Laws of 1964, No. 16, item 93 as amended), the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204 as amended), the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827 as amended).
\n1a. The notion of Services, as regards Services provided to the Consumer, also includes digital services within the meaning of the aforementioned Act of 30 May 2014 on Consumer Rights, which allows the Consumer to a) produce, process, store or access data in digital form, b) share data in digital form that has been uploaded or produced by the Consumer or other users of this service, c) other forms of interaction through data in digital form (in the Terms and Conditions as: \"Digital Services\"). The Digital Services are related to the technical operation of the Service consisting, among other things, of enabling the Service Provider to make material available through the Service.
\n(2) Every User shall have the right to lodge a complaint about the Services excluding Digital Services, in particular on matters relating to the performance of the Services, the fees for the Services or the amount of Services purchased.
\n2a. Any User who is a Consumer shall have the right to lodge a complaint with the Service Provider in the event of non-compliance of the Digital Service with the Contract within the meaning of the Consumer Rights Act. The Digital Service is in conformity with the Contract if, in particular, their:<\/p>\n

(a) description, type, quantity, quality, completeness, functionality, compatibility, interoperability and availability of technical support and updates;
\n(b) suitability for the specific purpose for which they are needed by the Consumer, which the Consumer has notified the Service Provider at the latest at the time of conclusion of the Contract and which the Service Provider has accepted.<\/p>\n

2b. If the Digital Service is not in conformity with the Contract, the Consumer may request that it be brought into conformity with the Contract. The Service Provider may refuse to bring the Digital Service into conformity with the Contract if bringing the Digital Service into conformity with the Contract is impossible or would require excessive costs for the Service Provider. In assessing the excessive cost to the Service Provider, all circumstances of the case shall be taken into account, in particular the significance of the non-conformity of the Digital Service with the Contract and the value of the Digital Service conforming to the Contract.
\n2c. The Service Provider shall bring the Digital Service into conformity with the Contract within a reasonable time from the moment the Service Provider is informed by the Consumer of the lack of conformity with the Contract and without undue inconvenience for the Consumer, taking into account their nature and the purpose for which they are used. The costs of bringing the Digital Service into conformity with the Contract shall be borne by the Service Provider.
\n2d. If the Digital Services do not comply with the Contract, the Consumer may make a declaration to reduce the price or withdraw from the Contract under the terms of the Consumer Rights Act.
\n(3) Complaints, including those relating to Digital Services, the recognition of which is taken over by the Service Provider, should be submitted electronically to the e-mail address kontakt@studia-wroclaw.pl from the e-mail address indicated in the process of registration of the User's Account on the Platform or by letter to the address of the Service Provider. The complaint submission should contain the data of the person submitting the complaint and a description of the reported objections.
\n4 The Service Provider will consider the complaint within up to 14 days of receipt.
\n(5) In the event that it is necessary for the Service Provider to obtain additional information in order to respond to the User's complaint, the User shall be requested by the Service Provider to provide such information. Making the request referred to in the first sentence to a User who is a Consumer shall not affect the running of the time limit referred to in clause 4 above; the complaint shall also be considered in the absence of a response from the User.
\n(6) The Service Provider reserves the right to extend the time limit for complaints if the investigation of the complaint requires special knowledge or encounters obstacles, the causes of which are beyond the Service Provider's control, with the prior consent of the complainant given within the time limit referred to in section 4 above.
\n7 The response to the complaint shall be sent to the User at the User's e-mail address indicated in his\/her Account or by post.
\n(8) In the event of a justified complaint, the User shall be entitled to claims under the Consumer Rights Act.
\n(9) Irrespective of the possibility of bringing an action before a common court of law, the User has the possibility to use, among other things, the following out-of-court ways of dealing with complaints and claims:<\/p>\n

a) a request for resolution of a dispute arising from a concluded agreement addressed to a permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Dz.U. 2001 No. 4 item 25 as amended), permanent amicable consumer courts operate at voivodship inspectorates of the Trade Inspection and at their local branches. The list of permanent amicable consumer courts is available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl\/wazne_adresy.php;
\nb) an application for initiating mediation proceedings, referred to in Article 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws 2001, No. 4, item 25 as amended), addressed to the voivodeship inspector of the Trade Inspection.<\/p>\n

(10) The User may contact the municipal (district) consumer ombudsman to obtain free legal advice or information on any type of dispute with the Service Provider - irrespective of the location of the Service Provider.
\n(11) The User may contact social organisations (consumer organisations) whose statutory tasks include consumer protection in order to obtain free legal advice or information on matters concerning any type of dispute with the seller - regardless of the place of establishment of the Service Provider.
\n12 The User may use the ODR Platform, located at: https:\/\/webgate.ec.europa.eu\/odr\/main\/?event=main.home.show&reload=false.
\n(13) The use of out-of-court complaint and redress procedures is voluntary and may take place if both parties to the dispute agree to it.
\n(14) If the parties fail to reach an amicable agreement, the common court in Poland shall have jurisdiction to settle any dispute.<\/p>\n

XI. WITHDRAWAL FROM THE CONTRACT<\/strong><\/h2>\n

(1) Subject to the provisions of the Terms and Conditions, the User may withdraw from the Agreement concluded with the Service Provider without giving reasons by submitting an appropriate declaration in writing to the Service Provider's address or by e-mail to kontakt@studia-wroclaw.pl within fourteen days from the conclusion of the Agreement. Sending the declaration before its expiry is sufficient to meet this deadline.
\n(2) The User may withdraw from the Contract by submitting a declaration of withdrawal to the Service Provider. The declaration may be made on the form, the template of which is attached as Appendix 1 to the Terms and Conditions. The use of the form is not obligatory - the User may also make a declaration of withdrawal from the Contract without using it.
\n(3) If the User has requested the commencement of the performance of the Services before the expiry of the withdrawal period, being aware that he\/she will lose the right to withdraw from the Contract and the Service Provider has performed the Services, the User is obliged to pay the amount for any services performed by the Service Provider which the Consumer has used up to the moment he\/she has informed the Service Provider in the manner referred to in point 1 above of his\/her withdrawal from the Contract.
\n(4) The User has the right to terminate the contract for free services at any time by sending a request to the Service Provider to delete his\/her Account. The User who is a Consumer shall have the right to withdraw from the Contract under the principles indicated in items. 1, 2 above.
\n(5) The User shall have the right to withdraw from the Agreement in the event of the Service Provider's failure to provide the Digital Services in accordance with the Terms and Conditions after having requested the Service Provider to provide them. If the Service Provider fails to deliver the Digital Service immediately or within an additional period of time expressly agreed by the parties, the User who is a Consumer may withdraw from the Contract under the terms of the Consumer Rights Act.
\n(6) The Service Provider shall only be obliged to reimburse the price for the part corresponding to the Digital Service that is not in conformity with the Contract and the Digital Service, the obligation to provide which has fallen due to the withdrawal from the Contract.
\n(7) In the event of withdrawal from the Agreement, the Service Provider may prevent the Consumer from continuing to use the Digital Service, in particular by preventing the Consumer from accessing the Service or by blocking the Account, which shall not affect the Consumer's rights granted to the Consumer under common law.
\n(8) In the event of withdrawal from the Agreement, the Consumer shall be obliged to cease using this Digital Service and making it available to third parties.<\/p>\n

XII. AMENDMENT TO THE CONTENT OF THE CONTRACT AND TERMINATION OF THE CONTRACT<\/strong><\/h2>\n

(1) This section relating to modification of the content of the Agreement and termination of the Agreement applies to the provisions of the Agreement in respect of the Digital Services provided. The Service Provider may make a change to the Digital Service that is not necessary to comply with the Contract, namely in justified cases:<\/p>\n

a) organisational and legal changes of the Service Provider, due to the need to maintain the transparency of the Service Provider with regard to those provisions of the Terms and Conditions which relate to data identifying the Service Provider, e.g. the name of the Service Provider, the address of the Service Provider's registered office;
\nb)\u00a0gdy zmiana Us\u0142ugi Cyfrowej jest konieczna lub mo\u017cliwa ze wzgl\u0119du na zmian\u0119 przepis\u00f3w powszechnie obowi\u0105zuj\u0105cego prawa w zakresie tych postanowie\u0144 Regulaminu, kt\u00f3re odnosz\u0105 si\u0119 do zmienionych przepis\u00f3w prawa lub rodz\u0105 konieczno\u015b\u0107 lub mo\u017cliwo\u015b\u0107 wprowadzenia nowych postanowie\u0144, a tak\u017ce gdy zmiana jest konieczna w celu realizacji obowi\u0105zku wynikaj\u0105cego z orzeczenia s\u0105du powszechnego lub decyzji administracyjnej w zakresie wynikaj\u0105cym z tych rozstrzygni\u0119\u0107 w odniesieniu do tych postanowie\u0144 Regulaminu, do kt\u00f3rych ww. rozstrzygni\u0119cia znajduj\u0105 zastosowanie, w tym zmiany uzasadniaj\u0105cej wprowadzenie zmian w programach kierunk\u00f3w w trakcie trwania roku akademickiego na Studiach licencjackich, Studiach in\u017cynierskich, Studiach magisterskich, Jednolitych studiach magisterskich lub Studiach podyplomowych w celu zgodno\u015bci Umowy z obowi\u0105zuj\u0105cym prawem;
\nc) when the change is related to the introduction of significant changes in the functioning of the Site, including those related to technical or technological advances involving changes in the Service Provider's systems with regard to those provisions of the Terms and Conditions that govern the functioning of the Site;
\nd) when a change is made to ensure the safety of the Users due to security reasons, including to prevent the use of the Website, in a manner contrary to the law or to these Terms and Conditions or in a manner that infringes the rights of the Users with regard to those provisions of the Terms and Conditions that are intended to ensure the safe use of the Website, including in a manner consistent with the law and the Terms and Conditions.<\/p>\n

The introduction of the changes referred to in this section of the Terms and Conditions shall not entail any costs on the part of the Consumer.
\n(3) The Service Provider shall inform the Consumer of the change being made by posting the relevant information about the change on the Consumer's Account.
\n(4) If the change referred to in paragraph 1 of this clause of these Terms and Conditions materially and adversely affects the Consumer's access to or use of the Digital Service, the Service Provider shall inform the Consumer in good time on a durable medium of the characteristics and date of the change and the right referred to in paragraph 2 or 3.
\n(5) In the case referred to in paragraph 1 of this clause of the Terms and Conditions, the Consumer may terminate the Agreement without notice within 30 days from the date of such change or the notification of such change if the notification was made later than such change.
\n(6) The provision of paragraph (5) above shall not apply if the Service Provider has provided the Consumer with the right to retain, at no additional cost, the Digital Service in accordance with the Contract in an unaltered state.<\/p>\n

XIII. FINAL PROVISIONS<\/strong><\/h2>\n

\n3 The Service Provider is entitled to unilaterally amend the Terms and Conditions for important reasons, i.e.<\/p>\n

a) organisational and legal changes of the Service Provider due to the need to maintain the transparency of the Service Provider with regard to those provisions of the Terms and Conditions which relate to data identifying the Service Provider, e.g. the name of the Service Provider, the address of the Service Provider's registered office;
\nb) when an amendment to the Rules of Procedure is necessary or possible due to a change of generally applicable laws with respect to those provisions of the Rules of Procedure which refer to the changed laws or give rise to the necessity or possibility of introducing new provisions, or due to the recognition of a specific provision of the Rules of Procedure as prohibited with respect to a provision of the Rules of Procedure recognised as prohibited;
\n(c) in the event of a change in the type and scope of the Services and in the terms or conditions relating to the provision of the Services by the Service Provider via the Platform, to the extent of those provisions of the Terms and Conditions which define the type and scope of the Services and the terms or conditions relating to their provision by the Service Provider;
\nd) to comply with an obligation arising from a final court ruling or an administrative decision to the extent resulting from such decisions with respect to the provisions of the Rules of Procedure to which such decisions apply;
\ne) introduction of significant changes in the functioning of the Site, including those related to technical or technological progress, including changes in the Service Provider's systems with regard to those provisions of the Terms and Conditions which regulate the functioning of the Site;
\nf) changes aimed at ensuring the safety of Users , including those aimed at preventing the use of the Site in a manner contrary to the law or to these Terms of Use or in a manner that infringes the rights of Users with respect to those provisions of the Terms of Use aimed at ensuring the safe use of the Site, including in a manner consistent with the law and these Terms of Use.<\/p>\n

(4) The Service Provider shall inform the User of the Terms and Conditions by posting the relevant information about the change on his\/her Account. The User has the right to terminate the Terms and Conditions with immediate effect within 7 days of being notified of the change of the Terms and Conditions. If the User does not exercise his\/her right to terminate the Terms and Conditions in the manner specified above, he\/she shall become bound by the provisions of the amended Terms and Conditions upon the expiry of the aforementioned period.
\n(5) If there are any questions or doubts regarding the change of the Terms and Conditions, it is possible to contact the Service Provider by e-mail at kontakt@studia-wroclaw.pl.
\n(6) In matters not covered by these Rules, in particular the submission of declarations of intent by the Users in electronic form, the provisions of the Act of 18 July 2002 on electronic service provision (Journal of Laws 2002, No. 144, item 1204 as amended) and the Civil Code (Journal of Laws 1964, No. 16, item 93 as amended), as well as the provisions of other laws shall apply.<\/p>\n

XIV. LEGAL BASIS<\/strong><\/h2>\n

(1) The activities described in these Regulations shall be carried out in compliance with the applicable legal provisions, including in particular:<\/p>\n

(a) by the Law on Higher Education and Science of 20 July 2018 (Journal of Laws 2018, item 1668, as amended).
\nb) the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2002, No. 144, item 1204 as amended).
\nc) the Telecommunications Act of 16 July 2004 (Journal of Laws 2004, No. 171, item 1800, as amended),
\n(d) the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended),
\ne) the Act of 23 April 1964. Civil Code (Dz.U. 1964, No. 16, item 93 as amended),
\nf) the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 1994, No. 24, item 83 as amended),
